A French-speaking Moroccan site recently looked into an article on the charges against Saad Lamjarred, citing large passages of what appear to be statements prepared by the investigators. Unpublished revelations that are generally cold on the back but suffer from some inconsistencies.
The site in question begins by raising some details of what happened the night of the facts between Saad Lamjarred and his victim Laura Prioul citing in the wake of overwhelming testimony to the disfavor of the Moroccan singer.
He then notes the contradictory statements of the accused who changes his version of the facts several times, the medical examinations giving more credence to the word of the victim than to the accused.
The article, which appears to be consistent by its numerous quotations, which corresponds too much to the reality of the events, nevertheless sins by its conclusion which does not seem to fit with the laws in force.
The editor believes that nothing is yet final and that a decision of the court would probably occur in January 2019 where we would always know according to this editor if the case would be judged at the Assizes or Correctional Court.
And where the editor of Lesinfos.ma really stumbles is when she says that Saad Lamjarred would be judged either for "rape" or for "sexual abuse". In this case, however, one can not speak in any way of "sexual assault" because this offense is only invoked if the victim is a minor.
This "sexual offense" being defined by article 227-25 of the penal code as: "the fact, by a major, to exercise without violence, coercion, threat or surprise, sexual assault on the person of a minor of 15 years, is punished by five years of imprisonment and 75 000 euros fine.
This offense is constituted even if the minor was consenting. If it were not, it is no longer a sexual offense but a more serious offense of sexual assault, or even rape (crime) if there has been penetration.
Let's just remember that Laura Prioul was a major at the time. Therefore, it is impossible to talk about sexual abuse for this case Saad Lamjarred.
